Robert A. Kagan’s influential book, first published at the beginning of the twenty-first century, is now brought up to date with a second edition. “Adversarial legalism,” in Kagan’s view, distinguishes law in the United States from the law of other developed countries in many ways, for example, heavy use of policymaking through litigation and punitive regulation, as opposed to bureaucratic and conciliatory techniques. He suggests that this situation is likely to continue. This essay, however, looks at the same phenomena from the standpoint of similarities rather than differences. It suggests that powerful economic and cultural forces, common to the modern world of developed countries, tend to push the legal systems of these countries in parallel directions. Convergence, rather than divergence, is therefore the trend in the legal systems of the Western world; and this trend is likely to continue in the future.

Summary
In February 1829, Harriet Farrell, aged seventeen, found herself on trial in the Old Bailey (the central criminal court of London), charged with “the willful murder of her bastard child.” Harriet was a servant, in the household of Jonathan Cook, a “trunk-maker.” Cook’s wife had asked her repeatedly if she was in the “family way”; but Harriet had always denied it. She denied giving birth, too; but the Cooks were suspicious, and they found the body of a baby in the privy. At this point, Harriet ended up in the hands of the law, charged with murder. But when she was tried in the Old Bailey, the jury returned a verdict of not guilty. They did find Harriet guilty of a lesser crime, concealing the birth of a child, and she was sentenced to a year in prison.

In this compelling book, Lawrence M. Friedman looks at situations where killing is condemned by law but not by social norms and, therefore, is rarely punished. He shows how penal codes categorize homicides by degree of intent, which are in turn based on society's sense of moral outrage. Despite being officially defined as murder, many homicides have historically gone unpunished. Friedman looks at early vigilante justice, crimes of passion, murder of necessity, mercy killings, and assisted suicides. In his explorations of these unpunished homicides, Friedman probes what these circumstances tell us about conflicts in social and cultural norms, and the interaction of law and society.

This paper asks how globalization relates to legal culture. It argues that there exists, at least in the developed world, a general global culture; it follows, then, that there must be a global legal culture as well. Not everyone in modern societies is completely drawn into the global legal culture, however, as the research of the David and Jaruwan Engel in Thailand suggests. In general, however, the legal cultures of modern, developed societies are strongly convergent. In particular, there is emerging a global and convergent culture of human rights. Some Asian scholars and political figures have argued that conceptions of fundamental human rights are culturally Western, and may not suit the cultures of the East. The paper argues, however, that the human rights culture is not “Western” so much as modern; it arose in the West, but it is no more unsuitable to Asian societies than the automobile and the computer, which also arose first in the West.
